The False Claims Act (FCA) carries hefty penalties for those found to have violated it so even the mere allegation of an FCA violation should worry a federal grantee. However, the FCA is complicated and it can be difficult to understand what constitutes a false claim. The Supreme Court’s 2016 decision in Universal Health Services v. United States ex rel. Escobar helps clarify FCA violations. 

This webinar will cover the FCA, its potential application to private non-profit grantees of any federal agency, and strategies for minimizing vulnerability. The discussion will include:

  • The applicability and scope of the FCA,
  • Key compliance requirements which, if violated, might subject a grantee to an allegation that it violated the FCA, and
  • Risk mitigation strategies, such as the promotion of increased communication between personnel with programmatic responsibilities and those responsible for certifying requests for payment.
