Phone Consultation Agreement

By purchasing Advice Line services through HealthCenterCompliance.com you affirm that the following are true:

I am authorized to engage Feldesman Tucker Leifer Fidell LLP (“FTLF”) for the legal and consulting services described below on behalf of my organization.

I wish to engage FTLF to provide a confidential Advice Line consultation regarding one or more of the following topics:

Questions related to federal legal, regulatory, and policy requirements, including, but not limited to:

  • The structure, operation, and implementation of effective corporate compliance programs or how to address specific compliance issues;
  • Section 330 requirements;
  • Billing/reimbursement rules;
  • Beneficiary Inducement Prohibition;
  • Anti-Kickback Statute;
  • Federal grants laws;
  • HIPAA privacy and security; and 
  • Eligibility to maintain medical malpractice liability insurance coverage under the Federal Tort Claims Act (“FTCA”) or other specific FTCA-related issues. 

I understand that certain inquiries may exceed the scope of the Advice Line consultations and that FTLF may offer to provide additional legal services under a separate engagement. Examples of these types of inquiries include, but are not limited to:

  • Inquiries that require legal research, analysis, or written work product;
  • Inquiries involving topics not listed above;
  • Inquiries involving advice that requires specialized legal knowledge of state or local law, employment and labor law, tax law (including employee benefits), intellectual property, real estate law, or is otherwise beyond the scope of our professional competencies.

Through a portion of my HealthCenterCompliance.com subscription allocated to Advice Line consulting services, or through an à la carte purchase, I have paid an advance for these Advice Line consulting services.

I agree that this engagement will terminate either:

  • For à la carte purchases, once the call has been completed. 
  • For subscription plans (Premium, Compliance, FTCA or HIPAA) or subscription Advice Line products (Compliance Officer, FTCA, or HIPAA), when my annual subscription expires.

I also can terminate this engagement at any time by submitting notice in writing to HealthCenterCompliance@ftlf.com. Similarly, FTLF may terminate this engagement at any time by submitting notice in writing to the email address associated with my account. Should the engagement terminate early, I will receive a refund of the portion of my advance based on the number of months of the subscription that have elapsed.

FTLF reserves the right, in our sole discretion, to decline furnishing legal advice. In cases where services were purchased à la carte, a refund of any advance fees may be made.
